The gloves come off in the debate over defective Chinese Drywall

Today, in an article on newsinferno.com, Senator Bill Nelson (D-FL) called for the resignation of Nancy Nord, head of the Consumer Products Safety Commission (CPSC), because of the CPSC's failure to respond to Florida’s drywall problems.

Nelson is quoted as saying, “The CPSC has the legal authority to stop the importation of this stuff and to cause a recall and utilize their legal authority to exact penalties and to seize the assets of these companies. Now, that’s what I have asked them to do... The CPSC ought to exert their powers, now the problem is, you’ve got a chairman, Nancy Nord that just is not doing their job and the administration is going to have to replace her with somebody that will.”

While the CPSC sent a five-member team to investigate in Florida, Nord's position is that it is too soon in the process to issue a recall.

Interestingly, the Chinese government has apparently launced its own investigation into the defective Chinese drywall and has told news sources that the Chinese FDA-equivalent is “very concerned” about the allegations made regarding the material.

While problematic reports have so far only come out of Florida, Louisiana, Alabama, and Virginia, the drywall was also imported through ports in California, Mississippi, Texas, South Carolina, North Carolina, New York, Georgia, Washington, Pennsylvania, and New Jersey. As summer approaches and temperatures rise, so likely will the number of reports in warm, humid locales as these are factors that exacerbate the drywall emissions.

I can't stand the fact that Nelson is blowing all his air directly at the CPSC and of course it's Bush appointed Chairman. This guy needs to get his nose out of this area, it"s something he knows nothing about. His comments wreaks of another opportunity to screw us over with another big bill with a ton of money going to his and Landrieus districts and/or state. There hasn't been a death or disability as a result of this tainted drywall to date. There's an inconvenience to these homeowners and many are sick because of it and the drywall should be replaced yes. All across the country many building defects affect homeowners as well and in many cases they are as serious if not more then this one. The magnitude of this problem allows it to be played as a serious one and again, it is. It just too bad people like Nelson and others want to politicize this issue rather then allowing the experts, home owners, builders, manufacturer, suppliers and other related parties to take care of this as we've always done. That would be through the court system, your profession. This isn't just drywall, it's a whole lot of other goods, services and items consumed daily here in America.

D, while I can understand your frustration, and appreciate your vote of confidence in the court system handling these problems, it is a heavy burden to bear alone. And sadly, we're always involved AFTER someone is injured. The purpose of the CPSC is to PREVENT these problems and protect consumers from injury. While I'm sure there is a good deal of politics involved in Nelson's criticism of Nord, she has not been a very effective leader of the CPSC. I can be fair and admit she inherited a pinto, and you just can't make a pinto into a Lexus overnight. But she has been pro-business, anti-consumer from the minute she accepted this post and at least as a consumer, I'm ready for someone who will put my health FIRST, before private interests. I think Nelson may have been quick to judge her on this issue since the CPSC investigators have not been in Florida that long, but there's a good chance that his frustration has been built up by her inability to quickly and safely handle all the problems that have cropped up during her term. Frankly, as the head of the CPSC, the fact that she does not seem to worry about the systematic failures pointed out by the peanut salmonella outbreak, the pistachios salmonella outbreak, the lead recalls for Chinese toys, or the complete inability of her agency to check imports from foreign countries, does not inspire confidence in her ability, regardless of which side of the political fence you come down on. NOBODY wants to die from what they eat or drink.

Right Amanda, nobody wants to die from what they eat or drink. Nobody wanted to die from airplanes flying into their workplace or from poisoned Tylenol either but because of some nut jobs, they did. These were intentional acts. The owner of the Peanut Butter company in Georgia I believe, knew he had a bad product but continued to deliver it. On the other hand the pistachio company was busted after Kraft alerted the FDA about their discovery of contaminated nuts they got from that plant. After all it looks like Kraft may have saved some lives by being so thorough themselves with their own quality control.
Are you really up to speed about why this drywall is bad? Do you know where it came from and who brought it into our country? Do you know why so much of it was used?
I believe that Knauf Plasterboard Tianjin Ltd did not deliberately produce this board to make Americans sick and contaminate homes. Their drywall is used in over 50 countries around the world. Now it is particularly interesting that in 2006 the mine they extracted the gypsum from was closed and another was used. Perhaps they discovered this problem only after it was too late. That is worth investigating.
Meanwhile every "expert" attorney or consumer advocate is out there instilling fear into homeowners all across the country. Do you know how many homes were built during this time period and how many people bought one? Do you know how many people have chronic allergy or sinus problems. And now we have many people like those I've described calling Americas Watchdog and other consumer protection groups claiming they too have a home built with tainted Chinese Drywall. I've talked to them and have inspected their homes only to find nothing but a family with allergies and sinus problems.
I am involved in Construction Defect Litigation. My job is Forensic investigation,inspections and testing of thousands of homes for plaintiffs involved in suits against home builders. Everyday I see serious defects that have been built into homes by builders knowing that these defects are their, yet due to time constraints such as move in and target dates, they intentionally ignore them. There are "undocumented workers" who claim to be experienced construction workers making up a large part of this industries work force. Most can't speak English yet they have to build the homes with plans that are in English. That hasn't worked to well either believe me. So yes, we do have a serious problem with this tainted drywall but we also have a serious problem with many other building defects knowingly being or have been built into thousands of homes. Landrieu, Nelson, and Wexler should be applauded for their efforts in helping the people with this problem, but they need to see the bigger too. Building defects have been a big problem in our country, yet they seem to have missed other opportunities to help in the past. Hurricanes and other natural disasters expose these defects, inefficient building practices, materials and designs. Where has the outrage been? They cannot be allowed to use this as an opportunity to take and spend more of our money wastefully. Lets find the bad board, deal with the replacement and then look at what we can do to prevent this from happening again. If replacement of the Chairman needs to implemented then find but lets fix the problem first and not point fingers or place blame until we"re absolutely sure. Correct the problem, yes. However we need to hold all these officials feet to the fire. When you make the big bucks, and get the big perks, you ought to be more accountable for all the mess. Especially noted in this past non-accountable for anything administration.
